Termination Appeal and Miracle Monkey Tape

Between digging around for a roll of miracle monkey tape when you have an inch of water in your boat and eagerly looking forward to another labor attorney phone call, my money is on the tape. I like labor attorneys well enough, but on average none of them are free. Plus, the need to call one usually leads to what Ricky Ricardo called the need to do some ‘splaining.’ Most people, while at a guest’s home, and standing over a toilet bowl with a plunger would agree it is far better to prevent problems before they start.

An excellent, preventive solution in the Employee Relations world is to implement a Best Practice’ Termination Process employees view as fair. I covered a good example of a Coaching, Counseling, and Corrective Action Process that has survived legal challenge in my 01/21/25 President’s letter. By the way, all of my President’s Letters are available on KeystoneHR.com. In today’s issue I will go beyond the basic termination process and introduce a value-added, complementary option. That is – Termination Appeal.

Basic Premise of a Termination Appeal Process

Offers a means for an involuntarily terminated employee to have his/her termination re-reviewed and potentially overturned.

Benefits of a Termination Appeal

Costs nothing, and this ‘good-will’ effort may be introduced as an employee benefit. It can also derail legal action against the company and provides additional defense in the event of a governmental agency inquiry. In my experience, having that process in place has contributed to favorable unemployment claim rulings 100 percent of the time. It can also assist in getting EEOC charges tossed. Having a Termination Appeal process in place may also offer a “poison pill’ in the event of a union attempt.
